Cases › Applications to reopen a determination
143 Employment Relations Authority determinations, newest first.
Under clause 4 of Schedule 2 of the Employment Relations Act 2000 the Authority may order an investigation to be reopened, on terms it thinks reasonable, and may stay the effect of its earlier order in the meantime. Reopening is not an appeal: a party who disagrees with the result challenges it in the Employment Court. It is granted sparingly, where needed to prevent a miscarriage of justice, for example where a party missed the investigation through no fault of their own, or where important evidence could not reasonably have been found in time.
