174 Employment Relations Authority determinations, newest first.
Authority determinations are published, usually with the parties' names, because open justice is the starting point. Under clause 10 of Schedule 2 of the Employment Relations Act 2000 the Authority can order that a name, evidence or other details not be published. It does so only where the person asking shows specific adverse consequences that justify departing from open justice, weighing their interests against those of the other party, third parties and the public, as the Supreme Court set out in Erceg v Erceg [2016] NZSC 135. The Employment Court restated that approach for employment cases in MW v Spiga Ltd [2024] NZEmpC 147.
