Cases › Interim applications
556 Employment Relations Authority determinations, newest first.
An interim application asks for urgent orders that hold the position until the full claim is decided. The most common is interim reinstatement under s 127 of the Employment Relations Act 2000, where an employee who has raised a dismissal grievance asks to return to work in the meantime. Others seek injunctions, for example to stop a former employee working for a competitor or using confidential information. The Authority asks whether there is a serious question to be tried, where the balance of convenience lies, and where the overall justice of the case lies. It does not decide the merits at this stage.
