Most of these matters are reviews under s 71ZB of the Parental Leave and Employment Protection Act 1987: a person asks the Authority to review a government department's decision about their entitlement to a parental leave payment, its amount, a transfer of the payment, or the recovery of an overpayment, and the Authority may confirm, modify or reverse the decision. An application must be made within 12 months of being told of the decision. Less often an employee brings a parental leave complaint under s 56, where the employer wrongly said they were not entitled to parental leave or that their position could not be kept open; dismissed them, or gave them notice, in breach of the Act's protection for employees who are pregnant or on parental leave (s 49); or otherwise acted to their disadvantage in their rights to parental leave or a parental leave payment. A complaint must generally be made within 26 weeks, and if the Authority finds a breach, s 65 lets it order reinstatement, repayment of lost wages and compensation.
