Kyle Spencer v Modern Transport Engineers Limited
A former general manager's personal grievance for unjustified dismissal against his employer, heard with the employer's claims against him for breach of his employment agreement over private work done by company staff. The Authority found the dismissal unjustified on process and ordered Mr Spencer to pay the company's damages; on the company's challenge, the Employment Court set aside the dismissal finding and fixed the damages payable. Costs in the Authority lay where they fell, and costs in the Court were reserved.
