NZ Post Primary Teachers' Association v Te Aho o Te Kura Pounamu Board of Trustees

This is a collective agreement interpretation dispute between the PPTA, the secondary teachers' union, and the board of trustees of the state distance learning school over whether teachers' one-hour lunch break falls within their 40 normal weekly hours of work under cl 11.2 of the secondary teachers' collective agreement. The Authority accepted the union's reading. On challenges by the board and the Secretary for Education, the Employment Court set the determination aside and held that the lunch break is additional to working hours.
