Byungok Jung v Asian Savour World Pty Limited

Byungok Jung, summarily dismissed by Asian Savour World Pty Limited for serious misconduct, applied to the Employment Relations Authority for interim reinstatement pending the investigation of his personal grievance. The Authority declined the application; the Employment Court set that determination aside and ordered interim reinstatement, the Court of Appeal declined the company leave to appeal, and the Employment Court later varied the terms of the order. The personal grievance itself had not been determined as at the last of these decisions.
