Yan Zhang v Frames Direct NZ Limited

Yan Zhang, a carpenter, brought an unjustified dismissal grievance, with arrears and penalty claims, against the respondent company, which said he was a contractor supplied through a labour hire company rather than its employee. The Authority found he was the company's employee and had been unjustifiably dismissed. The company challenged the determination in the Employment Court, which declined its application for a stay of execution pending the outcome of the challenge, and the Authority then fixed costs in a separate determination.
