Melissa Bowen v National Australia Bank Limited, Anthony Healy, Annie Brown and Rebecca Lee

Melissa Bowen sought penalties against National Australia Bank Limited and three senior employees of its subsidiary, her former employer, for allegedly aiding and abetting a breach of her employment agreement. The Authority struck the claim out for want of jurisdiction, dismissed it in the alternative as frivolous, and awarded costs to the respondents. On challenge, the Employment Court held that the Authority had jurisdiction over one pleaded implied term and that the claim was not frivolous, and otherwise dismissed the challenge.
