Xinhua Hao v South Pole IP Holding (NZ) Limited

Xinhua Hao, a food engineer, claimed his resignation from his employer was a constructive dismissal and sought unpaid wages and annual leave. The Authority upheld the claim and ordered compensation, wage arrears and holiday pay. In the Employment Court the company's application to stay those orders was declined and its challenge failed, leaving the Authority's awards payable.
