Maritime Union of New Zealand v Lyttelton Port Company Limited
Two maritime unions and a port company disputed whether the company had to involve the unions in formulating a proposal to disestablish 35 container terminal positions, or could consult only once a proposal was developed. The Authority found the collective agreements and the good faith duty had been breached and made a compliance order. On cross-challenges the Employment Court set that finding aside, holding the clauses relied on did not require engagement before a proposal was developed, and the Court of Appeal declined leave to appeal.
