Andries Gouws v Optimal Fire Limited

Andries Gouws and Estene Gouws were dismissed by Optimal Fire Limited for serious misconduct and brought personal grievances, while the company brought a damages claim against Mr Gouws. The Authority removed all three applications to the Employment Court without investigating them. The Court found both suspensions and both dismissals unjustified, awarded remedies to each of them, and dismissed the company's counterclaim.
