Russell Kinzett v Fire and Emergency New Zealand
Russell Kinzett, a firefighter of over 30 years' service, brought personal grievances after Fire and Emergency New Zealand summarily dismissed him following an investigation that found he had bullied and sexually harassed two co-workers. The Authority found the dismissal unjustified and reinstated him, reducing his compensation for contribution. The employer challenged the determination in the Employment Court; the judgments on file record that the Court set it aside, and deal with a stay pending Mr Kinzett's application for leave to appeal and the costs of that stay.
