Garth McGearty v Air New Zealand Limited
A senior wide-body captain brought personal grievances for unjustified disadvantage and age discrimination after his employer treated a collective agreement clause for age-restricted pilots as triggered when he turned 65, and placed him on leave without pay. The Authority held the employer acted as a fair and reasonable employer could have, and dismissed both grievances. The Employment Court reached the opposite conclusion on challenge, upholding both grievances with quantum left to the parties, and the Court of Appeal has granted leave to appeal.
