Philip Tighe-Umbers v Jetconnect Limited
Philip Tighe-Umbers, a pilot whose employment with Jetconnect Limited was ended on three months' notice after he declined COVID-19 vaccination, claimed he was unjustifiably dismissed. The Authority found the notice complied with his collective agreement, dismissed the claim and ordered him to pay costs. On his challenge, the Employment Court agreed the notice was lawful but found the dismissal unjustified because the company had not exhausted reasonable alternatives to termination, and it reserved remedies and costs.
