Gary McIvor v Sam Saad t/as Pita House

Gary McIvor claimed he was constructively dismissed by Samir Saad, who ran a pita bakery, after about a month's work there, and also claimed unpaid wages and holiday pay. The Employment Relations Authority found Mr McIvor was an employee owed arrears but had resigned rather than been dismissed. On his challenge the Employment Court held he was constructively and unjustifiably dismissed, and later judgments fixed money orders and dealt with a stay of execution.
