P and B Engineering Limited and Petersons Global Sales Limited v Karl Jacob Peterson and Carl James Peterson
Two companies, one marketing portable sawmills (Petersons Global Sales Limited) and one manufacturing them under licence, alleged that a father, Carl James Peterson, and his son, Karl Jacob Peterson, breached the restraint of trade, confidentiality and fidelity obligations of their employment by developing a competing sawmill. The Employment Relations Authority found for the companies; on the father's and son's challenge, the Employment Court set the Authority's orders aside and dismissed the companies' claims. A later costs judgment ordered one company to pay part of the father's and son's costs.
